We strongly believe in the privacy of our customer's information. Any information that you provide us within this site will only be used to process your order. B.Y.O. Products does not sell, rent, or loan any identifiable information regarding its customers to any third party for any reason other than fulfilling their requests.
TERMS AND CONDITIONS FOR PURCHASES:
Title Transfer - All sales are Freight on Board (F.O.B.) sellers facilities and title to customer's goods passes to customer at seller's facilities. Seller is not liable thereafter for any loss of the goods or damage to, or caused by the goods.
Liability - B.Y.O. Playground shall not be liable for incidental, indirect, special, or consequential damages. In no event will B.Y.O. Playground be liable for damages beyond the invoiced price.
Warranty - B.Y.O. Playground does not express or imply any warranty. All items are warranted by the manufacturer. Each manufacturer offers different warranties for different products. Please contact us for details about specific products. B.Y.O. Playground expressly disclaims liability for any injury, loss, or damage arising from the use or inability to use an item sold by us. Our only obligation is to replace an item that is delivered defective and this obligation is limited.
Changes in Specification/Pricing - All photos/specs/pricing are accurate at time of printing. However, due to changing market conditions and continual improvement in designs, we reserve the right to change designs, specifications, and pricing without notice.
Returns - Returned merchandise will be accepted for return only with prior authorization from B.Y.O. Playground. Return authorizations must be requested within 30 days of delivery acceptance. Freight charges will be prepaid by the customer. Returns are subject to a 15% restocking fee.
No returns are accepted after 30 days from your shipment date.
No returns for custom or nonstock items will be accepted.
No returns will be accepted for products once they have been installed.
Freight will not be refunded for returned items. Return freight is also the responsibility of the customer.
Cancellation - Non-stock metal and plastic components which are custom powder coated or manufactured to your color specifications (such as modular units, swing sets, etc) are subject to a 20% cancellation fee. This fee will apply if you cancel your order for these items or change your color choice after your order is placed. No cancellations are allowed on non-stock items after they have shipped.
UNLOADING OF FREIGHT:
Unless otherwise specifically stated, it is the customer's responsibility to unload their order from the delivery truck. Shipments will be delivered to or as close to your property line and or Driveway provided the location is deemed assessable by the delivering carrier. Please tell us at the time of purchase of any unusual or difficult location or delivery issues, so necessary arrangements may be made with the delivering carrier, where possible. There may be additional shipping costs depending on your specific situation.
The driver is not obligated to help you unload your freight (although some will), so be sure to have 1-2 people there to help you unload.
DAMAGED SHIPMENTS:
Occasionally, shipments will get damaged during transit. All merchandise must be inspected prior to signing acceptance from the carrier. If any damage is found, IT MUST BE NOTED ON THE BILL OF LADING. We cannot file a claim with the freight carrier if it is not noted and in such case, we cannot be responsible for any damage not noted on the bill of lading. If you cannot inspect the merchandise, please note on the bill of lading “Merchandise Received, but NOT inspected”.
MISSING PARTS:
All missing parts must be reported to us within 10 days of your receipt of your order. We will not replace any parts that are not reported within that 10 day period.
